I. General information基本说明
1. These Terms and Conditions define the principles of raising Orders for Goods presented on the Website available at the following address elegou.cn.tesco.com.
2. As of the moment of taking steps aimed at the use of the Website, each User is obliged to abide by the provisions of these Terms and Conditions. The below Terms and Conditions should be read carefully prior to the registration on or use of the Website, especially those paragraphs highlighted in bold in these Terms and Conditions.
1. 本条款与细则规定了在以下网站elegou.cn.tesco.com上进行商品订购的基本原则。
2. 在使用elegou.cn.tesco.com网站时,每位用户都应当遵守本条款与细则中所规定的内容。在该网站注册或使用该网站之前,请仔细阅读以下条款,特别是以粗体字标出的部分。
3. The terms used herein shall have the following meaning:本文中所使用的术语定义如下:
1) Website – the web platform located at the address: elegou.cn.tesco.com, consisting of graphic elements and software that allows for the provision of services electronically to Users, i.e. fulfillment of the Order. The Sellers' Goods are presented on the Website.
2) Order – the list of Goods that the Orderer wants to purchase, prepared and sent by the Orderer to the Seller through the application made available on the Website.
3) Tesco – the entity that manages and runs the Website, i.e. Tesco Holdings (China) Co., Ltd. whose registered office is at .

4) Seller/Sellers – Tesco stores as shown on the website who sell goods to the Orderer.
5) Orderer – a natural person having full capacity of civil conduct, or having limited capacity for civil conduct and engaging in activities appropriate to his age and intellect, a body corporate or an organizational unit or an entity not possessing the status of a legal person and engaging in activities within its permitted business scope that raises the Order. If any person or entity engages in any activities out of its capacity or business scope, then such an order is invalid from the very beginning. Tesco/Seller is entitled to cancel the order, deregister the user or reject to provide services or goods.

6) User – any natural person that makes use of the Website.
7) Goods – Goods presented by the Seller on the Website, from among which the Orderer may select items to raise an Order and then to purchase them when they have been offered to the Orderer by the Seller on delivery. Goods presented on the Website do not constitute an offer in the meaning of the PRC Contract Law.
8) PRC – People's Republic of China.
9) Price – the gross price of Goods, shown next to the information about them, excluding their Delivery Costs. Prices are given in RMB and do include VAT. Prices given on the Website are only guide prices. On delivery, Prices of specific Goods may differ from their Prices given on the Website and are Prices of Goods effective in the Location on the day of the delivery.

7) 商品 — 卖方在网站上提供的商品,订货人可以在这些商品中作出选择并发出订单,然后在卖方向订货人交货时完成购买。网站上提供的商品不构成《中华人民共和国合同法》意义上的要约。

9) 价格 — 商品的总价格,在各商品信息之后显示,不含配送费用。价格货币采用人民币,包含增值税。网站上提供的价格仅作为指导价。具体商品配送时的价格同网站显示的价格可能会有所不同,是该商品在配送当日在卖方卖场内的实际售价。
10) Delivery Costs – fees for the delivery of Goods to the Orderer. They are displayed on the Website at the moment of raising an Order for Goods by the Orderer.
11) Location – is understood as location of the relevant stores run by the Sellers under the "Tesco" brand, from where the delivery of Goods are made.
12) Account – the User's individual Account, created after their registration, by means of which the User raises Orders and manages their data given during the registration.
13) Login – email address given by the Orderer during the registration on the Website.
10) 配送费用 — 向订货人配送而产生的费用。订货人就某商品发出订单时,网站上会显示相应的配送费用。
11) 发货地 — 卖方使用“乐购Tesco”品牌运营的相关门店的所在地,即商品的发货地。
12) 账户 — 用户的个人账户,在用户注册后创建,用户可以利用其账户发出订单并管理注册信息。
13) 登录名 — 订货人在网站注册时提供的电子邮箱地址。
14) Customer Delivery Assistant – a natural person employed by the Seller or Tesco, who holds the Seller's power of attorney and who shall make deliveries of Goods to the place specified by the Orderer and conclude on the Seller's behalf a contract of sale of Goods with the Orderer.
15) Offer – a document, produced by the Customer Delivery Assistant in the place of the delivery, which includes all ordered Goods and their prices as well as unit prices being the final Prices at which the Orderer may purchase Goods.
16) Helpline – the telephone Support Centre for Website Users that operates daily from 8:00 a.m. to 11:00 p.m. on the phone number 4006-69-69-69.
14) 配送服务人员 — 由卖方或Tesco聘用的自然人,该自然人按照卖方的授权将商品送至订货人指定的地点,然后代表卖方同订货人完成商品销售合同。
15) 要约 — 配送服务人员在配送地点提交给订货人的文件,文件上列明了所有的订购商品、价格和单价,以上价格是订货人购买商品的最终价格。
16) 帮助热线 — 供网站用户使用的电话支持中心,工作时间为每天上午8:00到晚上11:00,电话号码为4006-69-69-69。
II.Website网站
1. The User should use the Website in accordance with its purpose and should abstain from any activities that may distort its correct operation. Such activities include in particular:
1) interference in the use of the Website by other Users, including preventing them from using it;
2) interference in the content or the technical nature of the Website.
2. Tesco shall regularly undertake activities to improve the quality of the Website operation. However, it makes a reservation that errors or technical problems with the use of the Website may appear. In the event of such a situation, the User should report it to the Tesco via the Helpline. Tesco shall forthwith make an effort to restore the correct operation of the Website.
1. 用户应当为妥善的目的使用网站,不得从事任何不当使用网站的活动。此类活动具体包括:
1) 影响其他用户对网站的使用,包括妨碍他们使用网站;
2) 影响网站的内容或技术性质。
2. Tesco将定期采取措施,改善网站的运行质量。但Tesco不保证网站在使用时不会出现错误或技术问题。出现此情形时,用户应当通过帮助热线向Tesco报告。Tesco将立即着手恢复网站的运行的工作。
3. Tesco reserves the right to temporarily restrict (in whole or in part) the Users' access to the Website in order to improve it or to carry out maintenance works without any prior warning sent to the Users.
4. Tesco shall not be responsible for:
1) disruptions in the Website operation arising from acts of God or unauthorized interference of Users/Orderers or third parties;
2) incompatibility of the Website with the User's end hardware and software or with the User's connection to the public Internet;
3) technical difficulties, including errors and failures in connecting the Website.
3. 为改进网站的运行或开展维护工作,Tesco有权临时(全部或部分)限制用户对网站的访问且无需事先告知用户。
4. Tesco将不会对下列情况承担责任:
1) 由于不可抗力或用户/订货人或第三方未经授权的干扰活动而导致的网站运行中断;
2) 网站同用户的终端硬件和软件或者同用户与公共网络的连接不兼容;
3) 技术困难,包括连接网站时出现的错误和故障。
5. Photographs of Goods presented on the Website are of a sample nature, are used exclusively to present Goods and may slightly differ from their true images resulting from change of package or other reasons. If a product offered by the Seller itself is not fully as described on the Website. In case of difference between picture and goods, neither Tesco or Seller will bear any liability. Your sole remedy is to return it in unused condition.
6. Any content of the Website, including trademarks, photographs, descriptions, applications, are legally protected. Any use of them, in whole or in part, constitutes a breach of the law.
7. The Seller presents only sample products to the User on the Website. After logging in, the Orderer can see products (Goods) from among which he/she may raise an Order.
8. In the event that Tesco finds mistaken information related to the presented Goods on the Website, Tesco has the right at its own discretion to withdraw or revise the relevant information.
5. 网站上提供的商品图片仅用作参考样品,用以对商品进行展示,由于包装变更或其它原因,商品的实际外观与网站上提供的商品图片可能会略有不同。如果卖方提供的商品与网站描述不完全相符,Tesco或卖方不承担任何描述不符的责任,您有权选择将商品以未使用的状态退回给卖方。
6.网站的任何内容,包括商标、图片、描述以及应用都受法律保护。对上述全部或部分内容的使用均为违法行为。
7. 卖方在网站上仅向用户展示产品样品。登录后,订货人可以看到可供他/她订购的商品。
8. 如果Tesco发现网站上提供的商品存在错误信息,Tesco有权自行决定删除或修改相关信息。
III . Registration注册
1. The fulfillment of the Order is limited to a defined area on the territory of the PRC. The delivery can be made only to Users whose delivery address given during the registration in on the area covered by the Seller's operation.
2. If the delivery address given by the User is not currently supported by the Seller, the User may request information about its inclusion in future to the area covered by the Seller's operation.
3. The placement of the Order and the subsequent purchase of Goods shall be possible only if the Orderer appropriately completes the registration form on which he/she gives data necessary for the Order fulfillment, i.e.:
The Orderer's name, exact address of the delivery, phone number, e-mail address (used later on as the login name), set-up password and confirmation of getting familiar with and acceptance of the Terms and Conditions.
1. 订单仅限在中华人民共和国境内的指定区域内执行。只有当用户在注册时提供的配送地址在卖方指定业务覆盖范围内时,卖方才会接收用户的订单并向用户配送商品。
2. 对于卖方目前暂时无法覆盖的用户提供的配送地址,用户可以向Tesco询问该区域未来何时能加入卖方业务覆盖范围的相关信息。
3. 订货人只有正确填写注册表格并提供执行订单所必需的所有信息后,才能发出订单并完成商品的购买,此类信息包括:
订货人的姓名、具体配送地址、电话号码、电子邮箱地址(随后将被用作登录名)、设置密码以及确认了解并接受本条款与细则。
4. In the event of a change of the Orderer's data given during the registration, the Orderer, after logging into their Account, should update them in "My Account" tab (by means of the registration form) of the Website or via the Helpline. The address or/and the telephone number may be changed on the Website. Other data may be changed only via the Helpline.
5. The Orderer must contact the Helpline to remove their Account from the Website.
6. Registration activities are performed only once. Subsequent Orders may be raised by logging into one's Account on the Website by entering the Login and the agreed password.
7. The Login and the password are confidential. The Orderer is fully responsible for any activities being the result of a disclosure of the Login and the password to third parties.
4. 如果订货人在注册时提供的信息出现变更,则订货人在登录其账户后,应当对网站上“我的账户”项下的信息进行更新(通过注册形式)或通过帮助热线进行相应更新。地址或/和电话号码可以在网站上变更,其它信息只能通过帮助热线变更。
5. 订货人对网站上账户的注销必须通过帮助热线来完成。
6. 用户只需在首次登陆网站时候进行注册。注册后,订货人可通过输入登录名和设置的密码登录其网站账户,然后发出订单。
7. 登录名和密码必须保密。对因将登录名和密码泄露给第三方所造成的一切后果,订货人应当负完全责任。
8. Tesco has the right to remove the Orderer's Account at any time without stating the reason or informing the Orderer about it, if:
1) Tesco has a reasonable suspicion that the Orderer violates provisions of these Terms and Conditions;
2) The Orderer undertakes activities that at least indirectly may involve interference into the Website structures to which such an Orderer does not have an access or if the Orderer, through their activities, destabilizes the Website operation, irrespective of the way and the technique of the unauthorized activities.
8. 在下列情况下,Tesco无需说明理由或通知订货人,即可随时注销订货人的账户:
1) Tesco有合理的理由怀疑订货人违反了本条款与细则的规定;
2) 订货人实施了能够间接干扰网站结构的行为(订货人无权进入网站结构),或订货人的行为损害了网站运行的稳定性(无论该行为采用何种方式和技术)。
9. Tesco/Seller is not responsible for consequences of the below actions performed by the Orderer:
1) giving false or incomplete data during the registration process or a failure to timely update them;
2) making the Login and the password available to third parties.
9. 对于订货人实施的下列行为所造成的后果,Tesco/卖方不承担任何责任:
1) 在注册时提供虚假或不完整的信息,或未能及时更新相关信息;
2) 向第三方提供登录名和密码。
IV . Raising Orders订货
1. The availability of the goods depends on the Seller's stock and the Seller does not guarantee availability of Goods presented on the Website.
2. If Goods ordered by the Orderer are not available, on delivery the Seller shall notify the Orderer the unavailability of the ordered Goods and offer equivalent Goods, if possible, whose character and Price shall be similar to Goods ordered by the Orderer. On delivery, the equivalent Goods shall be distinguished from among Goods covered by the Order and the Orderer shall have the right to refuse collection of all or a part of equivalent Goods offered by the Seller. The amount (value) of Goods that have been rejected shall not be debited from the Orderer's payment card if he/she gave the details of their payment card in advance to make an online payment.
1. 商品是否有货取决于卖方的库存,卖方并不保证网站上显示的商品一定有货。
2. 如果订货人订购的商品无货,配送时卖方应当通知订货人订购商品的无货状态,可能的话还应提供替代商品,其特性和价格应当与订货人订购的商品类似。配送时,替代商品应当同订单中的非替代商品相区别,订货人有权拒绝接受卖方提供的全部或部分替代商品。若订货人之前已经提供其支付卡的信息并完成网上支付,则退货商品的金额(价格)将不会从订货人的支付卡中扣除。
3. Prices given on the Website are guide prices. On delivery, Prices of specific Goods may differ from their Prices given on the Website because of changes in cost prices of products, small differences in the weight of products sold loose or the delivery of equivalent Goods instead of unavailable Goods. You may refer to "what is Guide Price" for more detailed explanation on Guide Price.
4. In the event of ordering weighed Goods, the Seller reserves the right to deliver Goods whose weight differs from the weight specified in the Order whilst the difference may not be greater than +/- 10%. If on delivery the difference in weight exceeds 10%, the Orderer has the right not to purchase such Goods.
5. In consideration of the stock available, the Seller may restrict the maximum of the products ordered in one single order. An Order of large quantities of a product can only be fulfilled at the discretion of the Seller in consideration of relevant stock. (For example, if the Orderer makes an order of 10 bottles of wine which would use up all the Seller's stock, the Seller is entitled to deliver 5 bottles only.)
3. 网站上提供的价格属于指导价。配送当日,具体商品的价格可能与之前网站上显示的价格有所不同,这主要是由卖方商品价格的变动、散装商品在重量方面的微小差异以及用替代商品替代缺货商品等原因造成。您可以参考《什么是指导价》,以获得更多有关指导价格的具体说明。

6. If in the event of Goods, whose Price is determined in accordance with their unit weight and whose nature allows for it, the Orderer orders a number of pieces instead of a given weight, the Seller shall deliver the ordered number of pieces. The Price shall be then determined in accordance with the weight of the ordered number of pieces of such Goods.
7. The Orderer raises an Order after logging into their Account on the Website. The Seller sends the confirmation of the Order to the Orderer to the email address given by the Orderer during the registration process. The Order remains available (visible) on the Orderer's Account for 2 years after raising it on the Account.
8. The Orderer may cancel the Order after logging into their Account on the Website or via the Helpline. The cancellation of the Order shall be approved by the Seller if it is made by the Orderer by 11.00 p.m. on the day preceding the delivery of Goods.
6. 如果商品的价格按照其性质可以由其单位重量决定,而订货人只提供了订购的件数没有提供订购的重量,则卖方应当按照订购的件数交货。此时,商品的价格应当根据该商品订购件数的实际重量确定。
7. 订货人在登录网站账户后提交订单。卖方会将订单确认函发送至订货人在注册时提供的电子邮箱。订单发出后会在订货人的账户中保留(可见)2年。
8. 订货人可以通过登录网站账户或拨打帮助热线取消订单。取消订单应获得卖方的同意,订货人在配送日前一天晚上11:00前取消的订单均将获得卖方的同意。
9. When delivering the order, the Customer Delivery Assistant will provide you with a delivery note and a till receipt. If the Orderer wants to receive an invoice, the Orderer should let the Customer Delivery Assistant know and the Customer Delivery Assistant will take your till receipt back to the Seller and ensure that an invoice is issued against it and mailed to the Orderer's delivery address. Should the Orderer fail to request for an invoice while the Customer Delivery Assistant is at delivery address, then the Orderer can take the delivery note and till receipt to the customer services desk in the store operated by the Seller which delivered the order and the Seller will be able to issue an invoice for you. The store address is stated on the top of your till receipt.
10. The Delivery Costs are not included in Prices of Goods. They depend on the day of the week and the time of the delivery. Information about the Delivery Costs shall be made available to the Orderer on the Website immediately after keying in the details of the Order.
9. 交付订货时,配送服务人员会向您提供配送单和现金收据。若订货人索要发票,订货人应当告知配送服务人员,配送服务人员将收回现金收据交给卖方,并确保比照该现金收据开立发票,邮寄至订货人的配送地址。如果订货人未能在配送服务人员抵达配送地址时向其提出索要发票的要求,订货人还可以携带配送单和现金收据至销售商品的卖方门店的顾客服务台办理。现金收据顶端会显示销售商品的卖方门店名称和地址。
10. 商品价格中不包含配送费用。配送费用根据配送时间及日期(星期几)确定。订货人在网站上输入订单具体内容后,网站会显示相关配送费用的信息。
11. Tesco reserves the right to an additional check of the Orderer's data, e.g. through a phone call.
12. If the Price of delivered Goods is higher than the Price of Goods given in the confirmation of the Order sent to the Orderer, on delivery the Orderer has the right not to purchase such Goods. The value of Goods that have been rejected shall not be debited from the Orderer's payment card if he/she gave the details of their payment card in advance to make an online payment.
13. A contract of sale of Goods is concluded between the Seller and the Orderer only if the ordered Goods have been delivered by the Seller to the place of the delivery specified by the Orderer and the Orderer gives their consent to purchasing them at the Price specified in the delivery note (which is regarded as Seller's offer to the Orderer) presented to him/her on delivery. The Website allows only for raising an Order whereas a contract of sale of Goods may be concluded as a result of the delivery and the approval of the Seller's Offer on Goods covered by the Order.
14. The Seller reserves the right to refuse fulfillment of the Order if the Seller has a reasonable suspicion that Goods were ordered with a breach of these Terms and Conditions.
11. Tesco有权以其它方式核对订货人的信息,如通过电话确认。
12. 如果交付商品的价格高于向订货人发出的订单确认函中的价格,订货人有权拒收该等商品。若订货人之前已提供其支付卡的信息并完成网上支付,则退货商品的金额(价格)将不会从订货人的支付卡中扣除。
13. 仅当卖方将订购商品送至订货人规定的配送地址后,且订货人同意按照配送时向其提供的配送单(视为卖方给订货人的要约)上规定的价格购买该等商品,卖方和订货人之间方能成立商品销售合同。本网站只接受以商品完成配送且订货人同意以配送单上的价格购买商品为商品销售合同成立要件的订单。
14. 如果卖方有合理的理由怀疑商品订购行为违反了本条款与细则之规定,卖方有权拒绝执行相关订单。要件的订单。
V . Protection of Personal Data个人信息保护
The rules of processing personal data have been given in "Privacy Policy" document being an integral part of these Terms and Conditions.
“个人信息保护政策”规定了处理个人信息的规则,该文件是本条款与细则不可分割的组成部分。
VI . Delivery配送
1. The Seller delivers Goods exclusively on the area of its operation that can be checked by clicking the link "Check availability of service" and clicking the district area on the map.
2. The Orderer may raise orders 24 hours a day on any day of the week.
3. If the Orderer wants the Order to be fulfilled on the following day, he/she should place the Order on a given day by 11.00 p.m. at the latest.
4. Deliveries are made between 10.00 a.m. and 10.00 p.m., 7 days a week.
1. 卖方仅在其开展业务的特定区域范围内配送,该区域范围可以通过点击“查看配送服务范围”链接然后点击地图对应区域查询。
2. 订货人可以在每周任意一天的任意时间提交订单。
3. 如果订货人希望卖方在次日完成配送,他/她应当最迟在前一日晚上11:00之前发出订单。
4. 配送时间为每周任意一天的上午10:00到晚上10:00之间。
5. The Seller shall take all efforts to fulfill the Order at the agreed date and time. However, the Seller shall not be responsible for any delays caused by acts of God.
6. In the event of selling Goods covered by a promotion or coming from a clearance sale, whose quantity is limited, the fulfillment of the Order is dependent on the sequence in which they arrive at the Seller. The Seller reserves the right not to fulfill the Order if the stock of the Goods covered by a promotion or a clearance sale is sold out.
7. During the registration on the Website, the Orderer gives the address of the delivery, which can be amended in "My Account" tab.
8. The value of Orders raised by a number of Orderers to the same address of the delivery shall not be aggregated.
5. 卖方应当尽最大努力按照约定的日期和时间执行订单。但是,对于由不可抗力造成的任何迟延,卖方不承担责任。
6. 对于促销或清仓处理销售的商品,由于该等商品数量有限,其订单的执行情况取决于卖方收到该类订单的顺序。如果促销或清仓处理的商品已经售罄,卖方可以不执行相关订单。
7. 订货人在网站注册时提供的配送地址,可以在“我的账户”项下进行修改。
8. 多个订货人提交的具有相同收货地址的多个订单,其金额不应累计计算。
9. The Seller reserves an opportunity to check the age of the person collecting the Goods. If it turns out that the person is under the age of 18 and no other person may collect the Goods, the Seller has the right to refuse giving them out, in particular when the Order involves alcoholic beverages.
10. The Seller shall not give out alcoholic beverages to intoxicated people.
11. In the event that the Orderer is absent at the address given in the Order at the time of the delivery selected by the Orderer, the Customer Delivery Assistant shall leave a note about the attempt of making the delivery at the door of the Orderer's home or notify the Orderer of the attempt of making the delivery by a phone call, text message or email. If the Orderer's absence was only temporary and the Customer Delivery Assistant has not yet returned to the Location, the Orderer may contact the Helpline to direct the Customer Delivery Assistant back to their home. If the Customer Delivery Assistant has already returned to the Location, the Order shall be cancelled.
9. 卖方有权查询收货人的年龄。如果卖方发现收货人的年龄不满18岁,且无法找到其他人收货时,卖方有权拒绝交货,特别是在订单涉及酒精类饮料产品时。
10. 卖方不得向酗酒者销售酒精类饮料。
11. 如果配送服务人员在约定的配送时间和配送地址无法找到订货人,则配送服务人员将在配送地址留下便条,或通过电话、短信或电子邮件的方式告知订货人上述情况。如果订货人只是临时离开,且配送服务人员尚未返回发货地,则订货人可以拨打帮助热线,通知配送服务人员再次返回配送地点。如果配送服务人员已经返回发货地,该订单将被取消。
12. The Seller reserves the right to refuse to make further deliveries if the Orderer has made Orders a number of times and each time he/she was absent at the address given as the address of the delivery, thereby the Offer was not presented or has made Orders a number of times and each time he/she did not choose any Goods from the presented Offer, thereby a contract of sale of Goods was not concluded.
13. In the event that the Customer Delivery Assistant deliver Goods at the address given in the Order, the Seller has reasonable grounds to believe the signature in the name of the Ordere is effective.
12. 如果订货人已订货多次且每次都无法在配送地址找到该订货人,由此无法向其提出要约,或订货人订货多次且每次向其提出要约时都不购买任何商品,由此无法订立商品销售合同,此时卖方有权停止接受订货人的任何新订单。
13. 配送服务人员按照订单上的地址配送后,卖方有合理理由认为出自该配货地址的订货人的签字是有效的。
VII . Payment Terms支付条款
1. The Orderer may choose one of the following methods of payment:
1) Online – by means of the following debit/credit cards: Visa, Visa Electron and Master Card. In case that the card is rejected, Tesco/Seller shall ask the Orderer to contact the issuer of the card and check if the card has that functionality.
2) Payment upon delivery of Goods – by means of the following debit/credit cards: Visa, Visa Electron, Master Card, Union Pay, American Express, Tesco IC card and Sand IC card.
1. 订货人可以选择下列支付方式:
1) 在线支付 — 通过下列借记卡/信用卡支付:Visa卡, Visa Electron卡和Master卡。如果上述支付卡被拒绝使用,Tesco/卖方应当要求订货人联系支付卡的发卡行,核对该卡是否还能继续使用。
2) 货到付款 — 通过下列借记卡/信用卡:Visa卡、Visa Electron卡、Master 卡、银联卡、American Express 、Tesco IC卡和杉德IC卡。
2. If the Orderer wants to make an online payment, their payment card shall be pre-authorized at the moment of raising an Order on the Website. Tesco reserves the right to pre-authorize an amount not higher than 20 RMB. The authorization of the whole amount of the Order shall be made no earlier than on the day when the Goods are delivered and purchased by the Orderer. Subject to the policies of the bank that issues the payment card of the Orderer, the final amount of the transaction shall be debited from the customer's bank account.
3. To reduce the risk of unauthorized access to the details of the Orderer's payment card, they shall be encrypted. 
2. 如果订货人采用在线支付的方式,当订货人在网站上提交订单时,支付卡上会设定一笔给卖方的预授权,预授权的金额不超过人民币20元。此预授权直到商品完成配送且订货人购买商品之日才会被执行,根据订货人支付卡发卡行的政策,最终交易金额将从客户银行账户中扣除。
3. 为降低未经授权获得订货人支付卡信息的风险,支付卡应当加密。
VIII . eCoupon电子优惠券
1. eCoupons can only be used online at elegou.cn.tesco.com and are subject to these terms and conditions, and any other specific conditions notified to the Orderer on the issue of an eCoupon. eCoupons are redeemable through the website indicated and not other websites or any Tesco stores unless specified otherwise. An eCoupon is redeemed by entering its code at the appropriate point in the online purchase process. Redemption may be subject to the Orderer providing proof of entitlement to use the eCoupon. Orderer's use of an eCoupon indicates his/her agreement to be bound by these terms and conditions.
电子优惠券只能在elegou.cn.tesco.com使用,使用时应遵守本条款与细则以及其它在电子优惠券发行时通知给订货人的有关规定。电子优惠券只能通过指定网站兑换,除非另有规定,不能通过任何其它网站或乐购Tesco门店进行兑换。在网上购物过程中,在规定位置输入电子优惠券代码,即可进行电子优惠券的兑换。兑换时,订货人可能被要求提供有权使用电子优惠券的证明。订货人对电子优惠券的使用即表明其已同意接受本条款与细则的约束。
2. eCoupons are, and remain at all times, the property of Tesco. The right to use an eCoupon is personal to the original recipient and may not be transferred. No eCoupon may be copied, reproduced, distributed, or published directly or indirectly in any form or by any means for use by an entity other than the original recipient, or stored in a data retrieval system, without the prior written permission of Tesco. eCoupons distributed or circulated without the written approval of Tesco, for example on an Internet message board or on a "bargains" website, are not valid for use and may be refused or cancelled.
电子优惠券属于且始终属于Tesco或卖方所有。使用电子优惠券是其最初认领人的专属权利,不得转让。未经Tesco或卖方事先书面许可,电子优惠券不得被以任何形式或通过任何手段直接或间接的复印、复制、发放或发行以供最初认领人以外的主体使用,电子优惠券也不得被存储在信息检索系统中。未经Tesco或卖方书面许可发布或流转的电子优惠券,如在互联网留言板或“便宜货”网站上发放或流通的电子优惠券是非法无效的,可能会被拒绝使用或注销。
3. The following conditions apply to any eCoupon unless expressly stated otherwise:
1) Each issued eCoupon will be valid for use by a recipient only once.
2) An eCoupon may not be used in conjunction with any other special offer or eCoupon.
3) eCoupons cannot be exchanged for cash or used to purchase gift-vouchers.
3. 电子优惠券适用以下条款,但另有说明的除外:
1) 对于每张已发行的电子优惠券,其认领人只能合法使用一次
2) 每张电子优惠券可能无法与其它特价优惠或电子优惠券同时使用
3) 电子优惠券不能兑换现金或用以购买礼券
4. Certain goods or services may be excluded from all eCoupon offers. Goods or services may be excluded and any such further exclusion will be notified to the Orderer along with the eCoupon or through the elegou.cn.tesco.com website. Any eCoupon issued before the announcement of the change will not be influenced by aforementioned change. eCoupons may be limited to redemption in respect of certain products or services or certain products or services may be excluded from the ambit of use of the eCoupon, in which case notice will be given to the Orderer at the time of issue of the eCoupon. Excluded goods and services will not count towards any qualifying conditions for offers and will not benefit from any promotional discount.
某些商品或服务不适用电子优惠券优惠。对于不能使用电子优惠券的商品或服务,Tesco或卖方将会在发放电子优惠券时明确说明,或通过网站elegou.cn.tesco.com做出通知。在上述通知前发放的电子优惠券将不会受到上述范围变更的影响。某些商品或服务可能会限制电子优惠券的兑换,某些商品或服务可能会无法使用电子优惠券,对于此种情况,我们会在发放电子优惠券时向订货人告知。不适用电子优惠券的商品和服务不能计入最低消费的计算,不享受任何促销折扣。
5. Where the redemption of an eCoupon is subject to a minimum spending requirement, the redemption is only permitted in respect of the purchase of qualifying products which will be communicated to the Orderer at the time of issue of the eCoupon. Excluded products and supplementary charges, such as delivery, gift wrap or postage & packing, shall not count towards a minimum spending requirement. If more than one minimum spend offer is valid for use in an Order, there must be sufficient qualifying spend to meet the requirements of each offer in total. For example, to use a ¥3 off ¥30 eCoupon and a ¥5 off ¥50 eCoupon in the same transaction (assuming that these eCoupons can be used together), the Orderer must spend at least ¥80.
使用电子优惠券应满足最低消费要求,只有在购满符合条件的商品时才能进行兑换,在发放电子优惠券时,Tesco或卖方会向订货人告知哪些商品是符合条件的商品。不适用电子优惠券的商品以及其他费用(如配送服务费、礼品包装费、邮费和包装费)不计入最低消费金额。如果某一订单中涉及多个最低消费金额,则总的消费金额应当不低于各最低消费金额之和。例如,在同一项交易中使用一张满30元优惠3元的电子优惠券和一张满50元优惠5元的电子优惠券(假设这些电子优惠券可以同时使用),订货人的总计最低消费额应当是80元。
6. The eCoupon reward value will be deducted from the total price of the qualifying items purchased. The price of qualifying items is determined at the day of delivery. As such Tesco reserves the right to withdraw any eCoupon from an Order should the minimum threshold not be met on the day of delivery due to price changes from when the Order was placed.
电子优惠券优惠金额将会被从符合条件的已购买商品的总价中扣除。符合条件的商品的价格以配送当日的最终结算价格为准。如果由于订单发出后价格出现变化(最终结算价与指导价存在差异),导致在配送日最终结算价格未达到最低消费金额,则Tesco或卖方有权撤销订单中的电子优惠券。
7. When the Orderer use an eCoupon, the Orderer warrant to Tesco that he/she is the duly authorized recipient of the eCoupon and that he/she is using it in good faith. eCoupons which are redeemed by any malicious use of the website or other technical loopholes will be deemed invalid. Tesco has the right to refuse the redemption of any eCoupon which is obtained through the aforementioned means. If the Orderer redeem, attempt to redeem or encourage the redemption of eCoupons to obtain discounts to which he/she or a third party are not entitled the Orderer, may be committing a civil or criminal offence.
If Tesco reasonably believe that any eCoupon is being used unlawfully or illegally, Tesco may reject or cancel any eCoupon and the Orderer agree that he/she will have no claim against Tesco in respect of any rejection or cancellation. Tesco reserves the right to take any further action it deems appropriate in such instances.
If Tesco refuse an eCoupon submitted as part of an Order, for any reason, Tesco will inform the Orderer before the Order is dispatched to advise of the correct cost of the Order and give you the opportunity to cancel the Order.
订货人在使用电子优惠券时,应向Tesco或卖方保证其是电子优惠券的合法授权认领人,订货人对电子优惠券的使用应遵守诚信原则。恶意使用网站或利用其它技术漏洞获得的电子优惠券无效,Tesco或卖方有权拒绝兑换以此种方式获得的电子优惠券。如果订货人通过兑换、试图兑换或唆使他人兑换电子优惠券的方式获得了其无权获得的优惠,这可能会触犯民事或刑事法律。
如果Tesco或卖方有合理的理由认为订货人正在违法使用电子优惠券,Tesco或卖方则有权拒绝或撤消相关电子优惠券,订货人同意,他/她不会就该拒绝或撤消向Tesco或卖方提起诉讼。此种情形下,Tesco或卖方亦有权进一步采取其认为适当的其它措施。
如果Tesco或卖方由于各种原因拒绝接受订货人连同订单一起提交的电子优惠券,我们将会在订单商品发出前告知订货人正确的订单价格,订货人将有机会撤销订单。
8. All offers are subject to availability and while stocks last. Tesco shall not be liable to any Orderer for any financial loss arising out of the refusal, cancellation or withdrawal of any eCoupon or any failure or inability of the Orderer to use an e-Coupon for any reason.
9. Tesco reserve the right to vary or terminate the operation of any eCoupon at any time without pre-notice. Any eCoupon issued before the announcement of the change will not be influenced by aforementioned change. The failure of Tesco to take any action in respect of a breach of these terms and conditions shall not constitute a waiver of their enforceability. Tesco reserves its rights in respect of these terms and conditions at all times.
8. 所有优惠活动均以商品可供应为前提,商品售完即止。对于因电子优惠券被拒绝、撤销或收回,或订货人因为任何原因未能或无法使用电子优惠券而造成的经济损失,Tesco或卖方不承担任何责任。
9. Tesco或卖方有权不经通知随时变更或终止电子优惠券的执行。在上述变更通知前发放的电子优惠券将不会受到上述范围变更的影响。Tesco或卖方未能对违反本条款与细则的行为提起诉讼并不构成其对本条款与细则可执行性的弃权。Tesco或卖方始终保留与本条款与细则有关的所有权利。
